Therapeutic Confidentiality
From Therapist to Client: Therapeutic confidentiality is vital to protecting clients' personal data during massages, treatments and other sessions. Professional therapists are legally and ethically obligated to ensure the confidentiality of their clients' information, following the guidelines set by the GDPR, national legislation and professional codes of ethics. Maintaining therapeutic confidentiality enhances client trust and protects both professionals and clients from legal and ethical repercussions.
Protection of Therapist from Client - Client: Therapeutic confidentiality is an important concept that protects not only the rights of clients but also of therapists. Therapists have the right to protect their personal and professional information from unjustified disclosures and actions by their clients. The legal protection of therapeutic confidentiality allows therapists to maintain their professional integrity and security, while ensuring that the relationship with the client is based on mutual trust and respect.
---
Therapeutic confidentiality is a fundamental principle that applies to all forms of health and therapeutic services, including massages, therapies and other sessions. Therapeutic confidentiality refers to the obligation of health professionals and therapists (separate professions) to maintain the confidentiality of information they obtain while providing their services to their clients. This principle protects the individual's personal data and ensures that it will not be leaked to third parties without their consent.
Legislation and Regulatory Framework for Therapeutic Confidentiality
In Greece, therapeutic confidentiality is regulated by various legal provisions related to the protection of personal data and professional ethics.
1.General Data Protection Regulation (GDPR)
The EU General Data Protection Regulation (GDPR - Regulation (EU) 2016/679) also applies in Greece and covers the protection of personal data, including that collected during therapeutic sessions, such as massages and other treatments. According to the GDPR, health data is considered "sensitive data" and is subject to strict protection rules.
The main principles of the GDPR regarding therapeutic confidentiality include:
Consent: Professional therapists must obtain clear and explicit consent from their clients for the collection, processing and storage of their personal data.
Right of access and rectification**: Clients have the right to request access to their data and to request its correction or deletion.
Data protection obligation**: Professional therapists must take all necessary measures to protect their clients' data from unauthorized access or leakage.
2. Law 3471/2006 on the protection of personal data in the field of electronic communications
Although this law mainly concerns data protection in the field of electronic communications, it can also be applied in cases where therapists communicate with their clients via electronic means (such as email or SMS).
3. Professional Ethics
Professional organizations and associations representing therapists, such as masseurs or alternative therapists, often have their own codes of ethics that include strict guidelines on therapeutic confidentiality. These guidelines often emphasize the need for absolute confidentiality and emphasize the obligation of professionals not to disclose any information obtained in the course of their professional practice without the express consent of the client.
Application of Therapeutic Confidentiality in the Case of Massage and Other Therapies
In the context of providing massage and other therapies, therapeutic confidentiality includes the following:
-Secure management of personal data: Therapists must keep all records and information they collect from their clients secure, whether they are physical documents or electronic data.
- Education and awareness: Therapists should be trained in the protection of personal data and be aware of their legal obligations.
- Security practices: Professionals should implement security practices, such as using strong passwords for electronic files, maintaining physical files in secure locations, and destroying data that is no longer needed.
Protection of the Therapist from the Treated - Served
Therapists, within the context of their professional practice, also have rights to protection from unjustified actions of the their clients:
1. Maintaining Confidentiality of Their Own Data: Like clients, therapists have the right to protect their personal data. The client is not allowed to disseminate sensitive information about the therapist without his consent.
2. Limiting the Spread of False Information: The client does not have the right to disseminate false information that may harm the professional reputation or personal life of the therapist. If this happens, the therapist may take legal action against the client for slander or defamation, in accordance with article 362-363 of the Penal Code.
3. Maintaining Professional Security: Therapists have the right to take precautionary measures to protect their personal safety and professional standing, such as using legal contracts that explicitly stipulate clients' obligations regarding confidentiality and information management.
4. Exclusion of Unwanted Clients: If a client violates the terms of therapeutic confidentiality or takes actions that threaten the therapist's professional standing or personal life, the therapist has the right to terminate the professional relationship and refuse future services.
Information the Client May Share
The client, according to the law, has the right to share their personal experiences from therapy. However, there are limitations on what can be leaked:
- Personal Evaluations and Experiences: Clients can share their personal experiences and opinions about the therapy they received. This may include the quality of service, the sense of security and the interaction with the therapist. However, they must be accurate and not violate the truth.
- Sensitive Information about the Therapist: The client does not have the right to disclose personal data of the therapist that is not publicly available, such as personal habits, family status or any other information concerning the therapist's personal life.
- Confidential Information: If the client has access to confidential information (degrees, etc., posted boards) related to the therapist's professional practice or personal life, he does not have the right to disseminate it without the therapist's consent. If this happens, the therapist may take legal action.
